Terms of Service - Eluzea Ballet Studio

 

1. General Information

1.1. These Terms of Service (“Terms”) govern participation in ballet and dance classes offered under the brand Eluzea Ballet School (“Eluzea”, “we”, “our”).1.2. Eluzea Ballet Studio is operated by Katerina Kolesnikova Grace Dance School, an individual sole proprietorship (indywidualna działalność gospodarcza) registered in Poland, NIP: 5214084244, with registered address al. Niepodległości 165/27, 02-555 Warsaw, Poland.1.3. By enrolling your child in classes, you (“Parent/Guardian”, “you”) agree to be bound by these Terms.

 

 

2. Enrollment and Trial Classes

2.1. Enrollment is confirmed once registration is completed and payment is received.2.2. Free trial classes may be offered but require advance registration. Attendance at a trial class does not guarantee a permanent place in a group unless enrollment and payment are completed.2.3. Parents/Guardians remain responsible for the child before and after class and must ensure timely drop-off and pick-up.

 

 

3. Tuition Structure

3.1. School-Year Program: Tuition at Eluzea Ballet is based on the entire school-year program (September–June). The total cost of the year is divided into 10 equal monthly installments. These installments are a payment plan for the annual fee, not payments for individual classes or months.3.2. Breaks Included: We do not bill in July or August. Payments remain the same each month, even if a month contains more or fewer class days. Breaks for Christmas, Winter holidays, Easter, and Polish public holidays are already included in the calculation.3.3. Number of Lessons: Across the school year, each weekday class averages around 38 lessons. Eluzea guarantees a minimum of 34 lessons per weekday class. If, for any reason, fewer than 34 lessons are delivered, we will arrange make-up classes, credits, or an extension.

 

 

4. Enrollment Timing

4.1. Joining Mid-Month: If a student begins partway through a month, the first payment is pro-rated according to the number of lessons remaining that month. This is calculated using the average weekly tuition rate (monthly installment ÷ 4). From the following month onward, families pay the regular flat monthly installment.4.2. Joining Mid-Year: Families may either (a) pay the standard monthly tuition for the remaining school months, or (b) prepay a discounted half-year package covering all remaining months.

5. Withdrawal

5.1. Tuition is an installment of the annual program fee, not a per-class charge.5.2. No refunds are given for partial months.5.3. Withdrawal requires written notice before the 1st of the month in order to take effect the following month. The current month’s installment remains due in full.5.4. In exceptional cases (such as relocation abroad), Eluzea may, at its discretion, offer a pro-rated adjustment.

 

 

6. Absences & Make-Ups

6.1. Tuition is non-refundable for student absences due to illness, travel, or scheduling conflicts.6.2. Families may request a make-up class, subject to availability.

 

 

7. Payments and Late Fees

7.1. Tuition and fees must be paid in advance, according to the selected payment plan (monthly, termly, or semester).7.2. Payment must be made by bank transfer (details provided separately) or other accepted methods published by Eluzea.7.3. Payments are due by the 5th day of each month (for monthly plans) or by the start date of the relevant term/semester.7.4. If payment is late, the student will not be allowed to attend classes until full payment is received.7.5. Repeated late payments may result in termination of enrollment.

 

 

8. Additional Costs

8.1. Tuition does not include recital fees, costumes, or special events, which may be billed separately.8.2. Participation in external performances, workshops, or exams may involve extra costs. These will always be communicated in advance.

 

 

9. Safety and Health

9.1. Parents/Guardians declare that the child has no health contraindications preventing safe participation.9.2. Any health issues, injuries, or discomfort must be reported to the instructor before class.9.3. Eluzea is not responsible for travel to and from the venue.9.4. Students and parents must comply with health, safety, and fire protection regulations of the rented premises.

 

 

10. Liability and Insurance

10.1. Participation in classes is at the student’s own risk.10.2. Eluzea is not liable for accidents, injuries, or damages except where required by law.10.3. Parents/Guardians are responsible for their child’s behavior and any damages caused.10.4. Personal belongings are the responsibility of the student. Eluzea is not liable for loss or theft.10.5. By signing the enrollment contract, Parents/Guardians also sign a liability waiver.10.6. Students are not insured by Eluzea. Parents are required to arrange their own accident insurance.

 

 

11. Attendance and Conduct

11.1. Students must arrive on time and wear appropriate ballet attire (leotard, skirt, leggings, soft ballet shoes, hair tied up).11.2. Changing shoes before entering the studio is mandatory.11.3. Parents and visitors are not permitted inside the dance studio during classes.11.4. Persistent disruptive or disrespectful behavior by a student or parent may result in termination of participation without refund.

 

 

12. Instructor Substitution

Eluzea reserves the right to substitute instructors when necessary (e.g., due to illness, professional commitments, travel). Substitution of instructors does not entitle students to refunds or termination of the contract.

13. Photography and Recordings

13.1. Classes and events may be photographed or recorded for marketing and promotional purposes.13.2. Parents/Guardians must sign a separate consent form for the use of their child’s image.

 

 

14. Communication and Marketing

14.1. Eluzea may communicate with Parents/Guardians by email or phone regarding class organization, schedules, and payments. Email is considered the official channel of communication.14.2. With your consent, Eluzea may also send newsletters and marketing communications. You can withdraw consent at any time.

 

 

15. Termination of Participation

15.1. Either party may terminate participation with 3 days’ notice, unless otherwise agreed in writing.15.2. Eluzea may terminate participation with immediate effect if:

  • Payments are overdue,
  • The student or parent fails to comply with these Terms or safety rules,
  • The student’s behavior endangers others.

 

 

16. Schedule and Program Changes

16.1. Eluzea reserves the right to change the timetable, class locations, or group assignments if necessary (e.g., insufficient enrollment, teacher availability, or changes required by the host venue).16.2. Such changes will be communicated to Parents/Guardians in advance where possible.

 

 

17. Complaints

17.1. Complaints may be submitted in writing by email to eluzea.info@gmail.com.17.2. Eluzea will review complaints and respond within 14 days.

18. Right of Withdrawal (Online Enrollments)

18.1. If enrollment is completed online, Parents/Guardians have the right to withdraw from the contract within 14 days under EU law.18.2. By attending classes within this period, you agree to waive your right of withdrawal to the extent services have already been provided.

 

 

19. Force Majeure

19.1. Eluzea shall not be liable for failure to perform or for delays in performance due to events beyond its reasonable control, including but not limited to natural disasters, epidemics, government restrictions, strikes, or closure of rented facilities.19.2. In such cases, Eluzea may offer online classes, make-up classes, or credits at its discretion.

 

 

20. Data Protection

Personal data is processed in accordance with Eluzea’s Privacy Policy, available on the website.

 

 

21. Amendments to the Terms

Eluzea may update these Terms. Parents/Guardians will be notified by email or via the website. Continued participation after such updates constitutes acceptance of the new Terms.

 

 

22. Governing Law and Jurisdiction

22.1. These Terms are governed by Polish law.22.2. Any disputes shall be resolved by the competent common court in Warsaw, Poland.22.3. The English version of these Terms is provided for international parents. In case of doubt, the Polish legal framework applies.
